Counter-Notice Period

The affected party has 10–14 business days to submit a valid counter-notice. If no counter-notice is received, the removal stands permanently.

Responding to a Takedown

Filing a Counter-Notice

If content you submitted to PregTips.com has been removed in response to a DMCA notice and you believe the removal was made in error — for example, because you own the rights to the content or your use qualifies as fair use — you may file a DMCA Counter-Notice.

A valid counter-notice must include the following:

  • Your physical or electronic signature.

Legal Doctrine

Fair Use Notice

PregTips.com acknowledges the Fair Use Doctrine (17 U.S.C. § 107) and the similar “fair dealing” provisions in other jurisdictions. Fair use permits limited use of copyrighted material without requiring permission from the rights holder in specific circumstances.

The four factors considered in determining fair use are:

4. Market Effect Does the use harm the potential market for or value of the original work? This is often the most important factor. Substitutive uses are rarely fair.
